DaFinch has yet to send his victims a single penny back from the money he stole from them in a pyramid scheme, even tho there is a federal court order telling him he has to.

The receiver for the ZeekRewards.com Ponzi scheme has filed a final judgement against those net winners who have yet to make arrangements to pay back fraudulently received funds.

According to the Zeek Net Winners Class website, on June 27 Kenneth Bell, the receiver for ZeekRewards, filed a motion to enter final judgments against those listed as net winner members. A ruling on the motion is expected July 31.

A “net winner” was calculated as an affiliate who received over $1,000 more from Zeek than they paid into the scheme. There are approximately 9,400 net winners worldwide that owe approximately $200 million.

From January 2010 through August 2012, Paul Burks owned Rex Venture Group, LLC, through which he owned and operated Zeekler, a sham Internet-based penny auction company, and its purported advertising division, ZeekRewards. Burks and his co-conspirators induced more than 900,000 victims, including over 1,500 victims in the Charlotte area, to invest in the scheme by falsely representing that Zeekler was generating massive retail profits from its penny auctions and that the public could share in such profits through investment in ZeekRewards.

Court documents state that in total, the scheme took approximately $939 million from its victims. Of that, Burks personally profited around $10 million.

ZeekRewards is said to be one of the biggest Ponzi schemes in United States history.

As a result of this filing on June 27, some of those net winners may find themselves subjected to being pursued by a collection agency. In an article in the Winston-Salem Journal, Bell stated the receivership is considering “selling” some or all of the judgements to a third party collection agency.

Included in the list of net winners in the final judgement petition are six residents from Davidson County and the amount they still owe the receivership.

They are Carl Wray of Thomasville, $267,134.71; Robert Floyd of Lexington, $13,600.16; Sherry Hedrick of Lexington, $5,862.79; Shane Mccullough of Lexington, $8,633.24; Jeffrey Nichols of Lexington, $12,047.11 and Angela Leonard of Lexington, $3,986.40.

The Zeek Net website states that the receiver is still willing to consider voluntary settlements with net winner class members and others against whom the receiver has claims.

“To date, there have been numerous settlements approved by the court in which net winners and the receiver agreed on an amount to be repaid, often with payment terms that allowed the net winner to repay the agreed amount over a number of months,” the statement read.

In November, the Western District Court of North Carolina found that the net winnings received from ZeekRewards were fraudulent transfers that must be repaid to the receiver and are subject to a constructive trust for the benefit of the receivership estate.

In the court documents, it was stated those listed have failed to respond in a timely manner to the receiver’s notice of repayment.

Also included in these payments is pre-judgement interest that has been calculated at 8 per year from August 17, 2012, which was the date of the last fraudulent payment, to November 2016, which was the date of the original summary judgement order.
